The CLE program, entitled "When Deals Go Bad Who Pays: Understanding How Courts View Indemnification, Hold Harmless and Fee Shifting Provisions,"  explores how courts apply various risk shifting provisions of commercial agreements. Understanding these provisions allows transactional attorneys to draft better business agreements and can also help commercial litigators evaluate cases.
