As part of the Bar Association of Montgomery County's annual meeting and Law Day activities, Jeff Schwaber will join a panel of litigators and transactional attorneys, including Doug Bregman and Ed Sharkey. The panel is titled "Lovers vs. Fighters: A Panel of Transactional Lawyers (the Lovers) and Litigators (the Fighters) Offer Various Perspectives on Common Contract Provisions." They will review and discuss many common provisions in contracts, examining (from the transactional lawyer’s perspective) why those provisions are included, how they are drafted, and how they are generally understood. The panelists will also examine (from the litigator’s perspective) why those provisions should be included and what they should cover, how those provisions may be challenged in litigation and how they may be viewed if the contracting parties end up in court.
