
New Law Raises the Risk for Insurance Companies
On May 17, 2007 Governor O’Malley signed into law Senate Bill 389 which holds insurance companies responsible for failing to handle their policy holders’ first party claims in “good faith.” Examples of such coverage would be uninsured claims in which the person who caused the accident has no insurance or underinsured claims in which the person who caused the accident does not have enough insurance coverage to pay for the damages. Although many lawyers throughout Maryland are still being educated in the particulars of this new law, Stein Sperling is already actively pursuing claims on behalf of our clients against their insurance companies for violations of the good faith statute.
